These terms cover the use of this website and the sale and delivery of materials by Swanson Sand & Gravel ("we", "us"). Placing an order means you accept them. A written quote or invoice from us governs if it says something different.
Quotes and pricing
- Quotes are estimates based on what you tell us, and are not final until we confirm the order.
- Unless the quote says otherwise, a quote is good for 30 days.
- Material prices change with supply and fuel costs. Prices are subject to change without notice.
- Prices do not include sales tax unless stated. A tax-exempt customer must give us a valid exemption certificate before delivery.
Quantities and the material calculator
The calculator on this site gives a rough estimate only. Weight per yard varies with moisture, gradation and how the material compacts. Check quantities with us before ordering. You are responsible for the amount you order.
Material is sold by weight or by volume as stated on the quote. Scale tickets govern weight. Natural materials vary in color, size and texture between loads, and photographs on this website are examples, not an exact match for what is delivered.
Availability
Materials are subject to availability. Some are seasonal or depend on supply, and we may substitute a comparable material only with your agreement.
Delivery
- Delivery dates and times are estimates. Weather, road conditions, equipment breakdowns and supply problems can move them. We are not liable for losses caused by a late delivery.
- You must provide safe, legal access for a loaded truck, and you must be sure the ground can carry it.
- Tell us before delivery about septic systems, tanks, wells, sprinklers, drain tile, cables, pipes, soft ground, overhead wires and low branches.
- We are not responsible for damage to driveways, curbs, sidewalks, lawns, landscaping, underground utilities or private surfaces caused by a truck going where you directed it. If our driver judges a spot unsafe, they will place the load in the nearest safe place.
- Someone should be present to show the driver where the load goes. If nobody is there, the driver places it where instructed beforehand, and that delivery is complete.
- A wasted trip, because access was blocked, nobody was there, or the order was cancelled after the truck left, may be billed.
Pickup and site safety
If you load or receive material at any site we direct you to, follow all posted rules and staff directions. Keep clear of moving equipment. Children must stay in the vehicle.
Payment
- Payment is due on delivery unless we have agreed to account terms in writing.
- Approved accounts are due within 30 days of the invoice date.
- Past due balances may carry a service charge of 1.5% per month (18% per year), or the maximum the law allows.
- You agree to pay reasonable collection and attorney fees on an account placed for collection.
- Returned payments may be charged a fee.
Cancellations and returns
Call as early as you can to cancel or change an order. Once material is loaded or a truck is on the road, we may bill for the trip. Delivered bulk material cannot be returned.
Claims
Inspect the material when it arrives. Report any problem with quantity or quality within 3 days of delivery, before the material is used or moved, so we can look at it. Our responsibility for any claim is limited to replacing the material or refunding what you paid for it.
Warranty
We sell natural and processed aggregate materials as they are. Except as stated here, we make no warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. You are responsible for choosing the right material for your project. We are happy to advise, but advice is not a guarantee of results.
Limit of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, including lost profits, delay costs or damage to work performed by others. Our total liability for any order is limited to what you paid for that order.
Using this website
We keep the website as accurate as we can, but material descriptions, photographs and the calculator are for general guidance and may contain errors. The content, logo and images are ours or used with permission, and may not be copied for commercial use. Do not misuse the website or its forms.

Governing law
These terms are governed by the laws of the State of Illinois, and any dispute will be handled in the courts of DeKalb County, Illinois.
Changes
We may update these terms. The version posted here when you place your order is the one that applies.
