Trailer Rental Terms of Service
Last updated: October 24, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Swanson Trailer Rental LLC, an Illinois limited liability company with its principal place of business at 1515 Brickville Rd, Sycamore, Illinois 60178 ("Swanson", "we", "us", "our"). They cover the rental of our dump trailers, our loading and haul-away services, and the use of our booking website.
Please read Section 9 (Prohibited materials), Section 12 (Placement and property damage), Section 17 (Limitation of liability) and Section 21 (Dispute resolution and arbitration) closely. They affect what you are responsible for, what we are responsible for, and how any disagreement between us gets decided. Section 21 requires most disputes to go to individual arbitration and gives up the right to a jury trial and to class actions, unless you opt out within 30 days.

1. Accepting these Terms
You accept these Terms when you book a rental or service with us, sign our booking agreement, or take delivery of our equipment, whichever happens first. If you do not agree, do not book.
Your booking confirmation — the agreement you sign at the time of booking, which states the equipment, the dates, the rate, the included weight and mileage, and any agreed extras — forms part of this contract. Where the booking confirmation and these Terms differ, the booking confirmation governs for that booking. Nothing said in conversation changes either one unless we confirm it in writing.
2. Eligibility and authority
- You must be at least 18 years old and able to enter a binding contract.
- If you book for a company, you confirm you are authorized to bind it, and "you" means both you and that company.
- You confirm that you own the property where the equipment will be placed, or have the owner's permission to place it there and to allow our truck onto the property. This matters: we rely on it, and it is the basis on which we drive onto your ground.
3. What we provide
Depending on what you book, we provide either:
- Trailer rental. We deliver a dump trailer to the address you give us, leave it with you for the rental period, and collect it with its contents at the end. You load it.
- Loading and haul-away. We bring the trailer and our crew, load the material you point out, and take it away the same visit. You do not keep the trailer.
The trailer's capacity in cubic yards is stated when you book. Capacity is a measure of volume, not of weight — see Section 7.
4. Booking, deposit and payment
- A deposit is required to hold your dates. The deposit is applied against the rental price; it is not an additional charge. It is refundable as described in Section 14.
- Rates are those shown at the time you book and stated on your booking confirmation. We may change our published rates at any time, but a change never affects a booking already confirmed.
- The balance, together with any additional charges under Section 7, is due on the terms stated on your invoice. Unless your invoice says otherwise, payment is due on receipt.
- You authorize us to charge the payment method you gave us for the balance and for any additional charges properly owed under these Terms.
- Amounts not paid when due accrue interest at 1.5% per month (18% per year), or the highest rate Illinois law allows, whichever is lower. You are responsible for our reasonable costs of collection, including court costs and reasonable attorneys' fees, to the extent permitted by law.
- A payment returned unpaid by your bank carries a returned-item fee at the maximum amount permitted by Illinois law.
- Prices do not include sales or other taxes unless stated. If you are tax-exempt, give us a valid exemption certificate before delivery.
5. The rental period
The rental period is the one stated on your booking confirmation. It begins when the trailer is delivered and ends when we collect it.
If you keep the trailer past the agreed end date, additional days are charged at our then-current daily rate. If you want more time, call or text us before the end date and we will extend it if the trailer is not already booked to somebody else. Keeping equipment past the agreed date without our agreement is a breach of this contract, and we may collect the trailer at any time after that date.
6. Delivery and collection
- We deliver on the first day of the rental and collect on the last. We do not guarantee a delivery or collection time, and we do not guarantee a time window. We will text you the morning we are coming.
- Delivery and collection depend on weather, road conditions, equipment and the jobs ahead of yours. We are not liable for delays caused by any of these. See Section 14 for what happens if we have to move your date.
- You do not need to be present for delivery or collection of a rental trailer, but the site must be ready and accessible as described in Section 12. If we arrive and cannot place or collect the trailer — the spot is blocked, a vehicle is in the way, a gate is locked, the ground is unsafe — that is a wasted trip and is chargeable at our then-current trip rate, and the deposit may be applied to it.
- For loading and haul-away service, somebody over 18 must be present to show our crew what is going, or the material must be out and clearly separated from what is staying. We will not guess, and we are not responsible for taking, or for leaving, anything where that has not been made clear.
7. Weight, mileage and additional charges
- Your rate includes an allowance of weight and a number of miles from our yard, both stated on your booking confirmation.
- Weight over the included allowance is charged per ton at the rate on your booking confirmation, based on the actual scale weight at the disposal facility, not on an estimate. You pay for what is in the trailer.
- Miles beyond the included distance are charged per mile at the rate on your booking confirmation.
- Certain items carry an additional charge because the disposal facility charges us for them, including mattresses, refrigerators and freezers, tires and televisions. Tell us what is going and we will give you the figure before the day.
- Additional charges may also apply for a wasted trip (Section 6), for extra days (Section 5), for removing prohibited or overweight material (Section 10), and for damage (Section 13).
8. Loading the trailer
- Nothing above the top rail. We cannot legally haul a load that is not contained within the sides of the trailer. If a load is overheight when we arrive, you must bring it down before we can move it, or we will, and that time is charged.
- Heavy material — concrete, brick, block, dirt, stone, roofing, plaster — weighs several times what household waste does. It must not go above the fill line marked inside the trailer, regardless of how much room is left. Tell us before the day if there is any.
- Load evenly and do not exceed the trailer's rated capacity. An unevenly or overloaded trailer is dangerous to tow.
- You are responsible for keeping the load within the limits set by Illinois law for vehicle and axle weight (625 ILCS 5/15-111 and related provisions). If the load is over the legal limit we may have to remove material before we can move it, and the time and disposal cost of doing so is charged to you. If we are cited or fined because of the weight or condition of a load you placed in the trailer, you are responsible for that fine.
- Do not burn anything in or near the trailer, and do not place hot ashes, coals or any smoldering material in it.
9. Prohibited materials
The following must never be placed in our trailers. They are not accepted at the facilities we use, and most of them are regulated under the federal Resource Conservation and Recovery Act (42 U.S.C. § 6901 et seq.) and the Illinois Environmental Protection Act (415 ILCS 5/1 et seq.).
- Paint, stains, solvents, thinners, adhesives and other liquid chemicals
- Motor oil, fuel, antifreeze, hydraulic fluid and other automotive fluids
- Batteries of any kind, including vehicle and lithium-ion batteries
- Propane tanks, pressurized cylinders, fire extinguishers and aerosols
- Asbestos or any material containing asbestos
- Pesticides, herbicides, fertilizer and pool chemicals
- Medical or biological waste, needles and sharps
- Ammunition, explosives, flares and fireworks
- Contaminated soil, and any material classified as hazardous waste or special waste under federal or Illinois law
- Appliances containing refrigerant, unless the refrigerant has been professionally removed and certified
- Any material whose disposal is restricted by law and which you have not disclosed to us in writing before the rental
You are solely responsible for what goes into the trailer, including material placed there by members of your household, your contractors, your guests, or by anyone else with access to the site while the trailer is in your possession.
If prohibited material is found in a load, you are responsible for all resulting costs, including removal, special handling, transport, lawful disposal, decontamination of our equipment, facility rejection or surcharge fees, regulatory fines, and any cleanup required by any authority. We may also return the material to the pickup address at your expense. This obligation survives the end of your rental.
10. Our right to refuse or stop a load
We may refuse to deliver, refuse to load, refuse to move, or stop work on any trailer where we reasonably believe that the load is overweight, overheight, unsafe to tow, contains prohibited material, or where the site or access is unsafe. Where we do, you remain responsible for the charges incurred to that point. We would far rather ring you and sort it out, and we will try to do that first.
11. Title to the contents
Everything in the trailer becomes our property once the trailer leaves your address, and we may dispose of, recycle or sell it as we see fit, without accounting to you. Check the trailer before we collect it. We cannot retrieve anything once it has gone, and we are not liable for the loss of anything placed in the trailer, whatever its value and whoever put it there.
12. Placement, access, permits and property damage
- You choose where the trailer goes, and you are responsible for making sure that spot is legal, firm enough to carry the weight, and reachable. We need roughly 30 feet of straight run and clear overhead access.
- Permits are your responsibility if the trailer is to stand on a street, alley, sidewalk or other public property, as is compliance with any homeowners' association or landlord rule. We are not responsible for fines, towing or removal arising from placement on public property without a required permit.
- You must tell us before delivery about anything below the surface or otherwise hidden — septic tanks and fields, wells, cisterns, sprinkler systems, drain tile, buried utilities, propane lines, heated driveways, underground rooms or vaults. We will work around what we are told about. We cannot work around what we are not told about.
A loaded trailer is extremely heavy. Driveways, aprons, curbs, sidewalks, pavers, asphalt, lawns, landscaping, septic fields and buried utilities can be marked, cracked, rutted or damaged by that weight even when everything is done carefully and correctly. By choosing the placement, you accept that risk, and except where the damage is caused by our gross negligence or willful misconduct, we are not liable for damage to the driving surface, the approach to it, or anything beneath it. If you are not willing to accept that risk, ask us to place the trailer on the street instead, and arrange a permit.
13. Care of the equipment while it is with you
From delivery until collection the trailer is in your care, custody and control. While it is with you:
- Do not move, tow, lift or relocate it, and do not allow anyone else to. If it needs to move, call us.
- Do not let anyone else use it, and do not sublet or assign your rental.
- Do not paint, mark, drill, cut, weld or alter it, and do not remove or cover any decal, placard or serial number.
- You are responsible for loss of or damage to the trailer while it is in your possession, from any cause other than our own negligence and other than ordinary wear from proper use. That includes fire, theft, vandalism, graffiti, collision, flood and damage from material placed in it.
- If the trailer is damaged, stolen or vandalized, tell us immediately on (779) 270-0500, and report theft or vandalism to the police.
- You are responsible for our reasonable cost of repair or, where it cannot economically be repaired, of replacement, together with the rental revenue lost while it is out of service.
- Excessive cleaning required because of what was put in the trailer is chargeable.
14. Cancelling and rescheduling
- Call or text (779) 270-0500.
- More than 24 hours before the delivery day, your deposit is refunded in full or moved to a new date, whichever you prefer.
- Inside 24 hours, or if we arrive and cannot place the trailer or cannot do the work, the deposit is retained to cover the trip and the day nobody else could book.
- If we have to move your date — for weather, a breakdown, a job that runs over, or anything else — we will tell you as soon as we know, and you may take a new date or a full refund of your deposit. That refund is our entire responsibility for a date we move, and we are not liable for any other cost or loss arising from the change.
15. Insurance
We carry the insurance required of us to operate. Our insurance does not cover your property, your premises, the contents of the trailer, or the work you are doing. You are responsible for your own insurance. If you are a contractor or are using the trailer for business purposes, we may require you to provide a certificate of insurance before delivery.
16. Disclaimers
The equipment is provided "as is" and "where is". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the equipment is suitable for any purpose other than the ordinary containment and transport of permitted material.
Estimates of capacity, weight and cost given on our website or in conversation are estimates. Actual weight and actual charges are determined as set out in Section 7.
17. Limitation of liability
To the fullest extent permitted by Illinois law:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, delay, loss of use, or the cost of substitute services, however caused and on any theory of liability.
- Our total liability arising out of or relating to any booking, however caused, will not exceed the total amount you paid us for that booking.
- Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, for fraud, or for gross negligence or willful misconduct.
These limits apply even if a remedy fails of its essential purpose, and they reflect an agreed allocation of risk between us which is part of the price you are charged.
18. Indemnification
You agree to defend, indemnify and hold harmless Swanson Trailer Rental LLC and its members, managers, employees, contractors and agents from any claim, demand, loss, liability, fine, penalty, damage, cost or expense (including reasonable attorneys' fees) arising out of or relating to:
- material you or anyone with access to the site placed in the trailer, including any prohibited or hazardous material and any cleanup or regulatory action resulting from it;
- your choice of placement and the condition of the site and its access;
- injury to any person or damage to any property occurring at the site or arising from the use or loading of the trailer while it is in your possession;
- your breach of these Terms or of any applicable law, ordinance, permit or HOA rule.
This section survives the end of your rental.
19. Text messages and calls
When you give us your mobile number, you agree that we may call and text you about your booking — confirmations, the morning we are coming, delays, and billing. These are service messages about your own job, not advertising. Message and data rates may apply.
Reply STOP to any message to opt out, or HELP for help. Opting out of texts does not cancel your booking, and we may still need to reach you by phone or email. Our full text messaging terms are at swansongravel.com/terms. Consent to marketing messages is not a condition of renting from us (47 U.S.C. § 227).
20. Electronic signatures and records
You agree that signing our booking agreement electronically, checking a box to accept, or otherwise confirming a booking through our website has the same legal effect as a handwritten signature, under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and Illinois law. You agree to receive this contract, your booking confirmation, invoices and notices electronically. You may withdraw that consent and ask for paper by contacting us, which may delay your booking.
21. Dispute resolution and arbitration
This section affects your legal rights. It requires most disputes to be resolved by individual arbitration rather than in court, and gives up the right to a jury trial and to participate in a class action. You may opt out within 30 days.
Talk to us first. Most problems are a phone call. Before starting arbitration or any proceeding, contact us at (779) 270-0500 or info@swansongravel.com and describe the problem and what you want. Give us 30 days to put it right.
Arbitration. If we cannot resolve it, any dispute arising out of or relating to these Terms or to any booking will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in DeKalb County, Illinois, or by remote hearing. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
Class action waiver. Arbitration is on an individual basis only. Neither of us may bring a claim as a plaintiff or class member in a class, collective or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative proceeding.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to stop unauthorized use of or damage to property. Our collection of unpaid amounts may also be brought in court.
How to opt out. You may reject this arbitration agreement by sending written notice within 30 days of first accepting these Terms to Swanson Trailer Rental LLC, 1515 Brickville Rd, Sycamore, IL 60178, or to info@swansongravel.com, stating your name, the address of the rental, and that you opt out of arbitration. Opting out affects nothing else in these Terms, and will not affect your booking in any way.
If the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.
22. Governing law and venue
These Terms and any dispute between us are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to Section 21, you and we consent to the exclusive jurisdiction and venue of the state and federal courts serving DeKalb County, Illinois.
23. Your rights under Illinois law
Nothing in these Terms waives or limits any right you have under the Illinois Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505) or any other right that cannot lawfully be waived. If any provision here conflicts with such a right, that right prevails and the rest of these Terms continue to apply.
24. General
- Changes. We may update these Terms. The version posted here when you book is the version that applies to that booking, so a later change never alters a rental you have already agreed.
- Entire agreement. These Terms and your booking confirmation are the whole agreement between us about your rental, and replace anything said or written before.
- Severability. If any part of these Terms is held unenforceable, the rest stays in force.
- No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
- Assignment. You may not assign your rental. We may assign this contract to a successor in our business.
- Events outside our control. We are not liable for failure or delay caused by weather, flood, fire, road closure, accident, equipment failure, labor shortage, facility closure, utility failure, act of government, or anything else beyond our reasonable control.
- Notices. We may give notice by text, email or post to the details on your booking. Notices to us go to the address in Section 25.
